Terms & Conditions

Please read these terms carefully before engaging EcoScape Gardens for any services.

Last updated: September 2026  ·  These terms apply to all services provided by EcoScape Gardens (ABN 41 059 962 301), operating in Victoria, Australia.

1. Definitions

Just so we're on the same page with the language used throughout these terms:

  • "EcoScape" means EcoScape Gardens, its operators, employees and subcontractors — that's us.
  • "Client" means the person, company or organisation engaging us for services — that's you.
  • "Services" means any gardening, grounds maintenance, landscaping or related work we carry out.
  • "Site" means the property or premises where we're doing the work.
  • "Quote" means the written or verbal pricing we've provided before starting work.

2. Quotes & Acceptance

All quotes are valid for 7 days from the date issued, unless we've agreed otherwise in writing.

When you confirm a quote — whether in writing, by email, SMS or verbally — that's us both agreeing to get the job done. By accepting, you're also agreeing to these Terms & Conditions.

Our quotes are based on a site inspection or the information you provide us. If the actual scope turns out to be different from what we quoted — for example, because of concealed obstacles, site conditions we couldn't see at inspection, changes to the site after our visit, or additional requests — we'll let you know and provide a revised quote before we go any further.

3. Scope of Services

We'll carry out the work as described in the agreed quote. If you'd like anything extra done on the day, just ask — we'll give you a separate price and get your go-ahead before we start.

We reserve the right to decline work that is unsafe, illegal, outside the agreed scope, or that requires specialist equipment we don't have available at the time.

For ongoing scheduled clients — we understand that gardens change and things come up. If your needs shift over time, talk to us and we'll do everything we can to work those changes into your regular service. We'd rather adapt with you than have you feel locked in.

For one-off jobs — we do need to stick fairly closely to what was quoted, as our scheduling and resources are planned around that scope. If something changes on the day or you need additional work done, please let us know as soon as possible and we'll discuss options.

For ongoing maintenance contracts, we'll work out a regular schedule with you. We do reserve the right to adjust the day or timing of a visit due to weather, equipment issues or other things outside our control. For example — if there's been heavy rain and we're at risk of damaging your lawn with the ride-on mower, we'll hold off until conditions improve. We'll always keep you in the loop.

4. Payment Terms

Unless we've agreed something different in writing, here's how payment works:

  • Commercial clients: Payment is due within 7 days of invoice, unless we have a separate arrangement in place.
  • Residential clients: Payment is due on the day of service, unless you've made prior arrangements with us. For end of lease work, payment is required before we start.
  • Large projects: We may ask for a deposit of up to 50% before we begin, with the balance due on completion.

If an invoice goes overdue, a late payment fee of 5% per month may apply on the outstanding balance. We also reserve the right to pause ongoing services where payment hasn't been received by the due date.

We accept bank transfer (EFT), cash and credit card. Credit card payments may incur a small processing fee.

5. Cancellation Policy

Life happens — we get it. If you need to cancel or reschedule, just give us at least 24 hours notice and there's no problem. Cancellations with less than 24 hours notice may incur a fee of up to 50% of the scheduled service value.

For ongoing contracts, either of us can end the arrangement with 14 days written notice. Any work completed up to that point will be invoiced and payable in the usual way.

If we need to reschedule due to weather or something on our end, no cancellation fee applies — we'll get it rebooked as soon as we can.

6. Site Access

To make sure we can get the job done safely and on time, we ask that you:

  • Make sure gates, doors and access points are unlocked, or give us the access codes in advance.
  • Clear any vehicles, equipment or obstructions that would get in the way.
  • Let us know about any known hazards on site before we start.

If we can't access the site on the day because of something on your end, a call-out fee may apply.

7. Liability & Property Damage

We take care with everything we do and hold $20 million public liability insurance. That said, our liability for any claim is limited to the value of the work we performed. We're not liable for:

  • Damage that was already there before we arrived.
  • Damage to underground services (pipes, cables, irrigation) where we have taken reasonable precautions including checking available service location information prior to commencing any excavation or digging work, or where the underground service was not installed in accordance with applicable legal requirements — for example, where pipes or cables were not buried at the depth required by law.
  • Natural die-back or plant loss after pruning or trimming carried out in line with standard horticultural practice.
  • Any consequential or indirect losses.

Where our work involves any digging or excavation, we will take reasonable precautions including consulting the Dial Before You Dig service where applicable. We ask that you disclose the known location of any underground services, irrigation systems or other infrastructure on your property before we start — the more we know, the better we can protect your site.

8. Chemical Applications

Where spraying or chemical treatments are part of the job, we carry out all applications in accordance with Victorian regulations and hold the appropriate AQF3 Chemical Accreditation licences. We add dye to all our spray mixes so you can clearly see where we've been — no guessing, full transparency.

9. Weather & Delays

We'll always do our best to stick to the schedule. But sometimes the weather or something else outside our control means we need to push a visit back. This includes things like:

  • Conditions that make it unsafe to work — extreme heat, lightning, high winds or heavy rain.
  • Equipment breakdown.
  • Other circumstances genuinely beyond our control.

For scheduled clients, we'll complete the service as soon as conditions allow — typically within the same week.

10. Disputes

Look, if something's not right — please just tell us. We're not precious about it. We genuinely want you to be happy with the work, and like anyone, we might occasionally miss something or get something wrong. If that happens, let us know as soon as you can and we'll sort it out.

We're here to help, not to argue. A quick call or message is all it takes and we'll do our best to make it right as soon as possible.

These terms are governed by the laws of Victoria, Australia. If for some reason we genuinely can't resolve things between us, any disputes will fall under the jurisdiction of the Victorian courts — but honestly, we'd much rather just fix it and move on.
